Two separate problems arrived at once. The immediate one is unsupported mass suspended in the air — hung limbs and cracked-but-attached wood have no predictable timing and come down with no wind at all. The longer one is that a torn top is a wound the tree cannot close, dropping a decay column straight down the center of the stem and leaving no leader to rebuild from. Whether this tree has a future is a question for next month. Whether anyone should be standing under it is a question for right now. Shelbyville's residential rings are precisely datable: the West Side Historic District's 373 contributing buildings went up between about 1853 and 1939, while a post-WWII boom produced the Sunset (platted 1950), Hilltop Village, Wellington Heights and Crestmoor additions — the city's own neighborhood study identifies Wellington Heights as where suburban Shelbyville began in the 1950s. Duke Energy Indiana serves Shelbyville per the IURC's service-territory GIS. Duke operates under the IURC tree-trimming rule (170 IAC 4-9): at least two weeks' notice before trimming, no removal of more than 25% of a tree and no topping without the owner's permission except in an emergency, no trimming beyond the easement or right-of-way without consent, and all debris removed within three days.
There is no blanket permit to remove a tree from private property, but Shelbyville regulates trees harder than most Indiana cities its size. Under the Unified Development Ordinance (last amended November 5, 2025), landscaping standards are triggered whenever an Improvement Location Permit is pulled for a new primary structure or a 50%-or-greater expansion. Inside that trigger, all existing healthy, mature, non-invasive trees over six-inch caliper standing in a required setback shall be preserved — the owner may ask the Zoning Administrator to waive it only on a finding that preservation would substantially interfere with site development. Remove a healthy tree that counted toward landscape requirements and the replacement rate is three for one, like for like, under a newly approved landscape plan.
