The cambium — the living layer just under the bark that builds new wood and moves food down to the roots — was killed in that patch, and the tree is now conducting around a dead strip. A narrow strip gets grown over in a few seasons and leaves a scar. A strip that wraps far enough around leaves the tree partly girdled, and the crown above it thins as the remaining live tissue gets overloaded. Either way the exposed wood becomes an open invitation to borers and canker fungi that would not touch intact bark. In Fortville — Mt. No permit is needed to remove a tree in your own yard. Fortville does, however, have a real tree code — Chapter 95, the "Town of Fortville Tree and Flora Ordinance" (Ord. 2002-7A) — and it is stricter than most towns this size. A permit is required to plant anything in the town right-of-way (95.18). Topping or severe trimming of public trees is forbidden (95.11). No arboricultural work may be done on a town tree without a special permit from the Tree Program Supervisor (95.19). A separate special permit is required before a builder destroys or significantly alters forest or woodland during subdivision, grading or construction (95.21). Illegal removal or damage carries fines of up to $1,000 per violation plus replacement billed at $100 per DBH inch (95.99). Section 95.10 places clearance duties over streets, alleys and sidewalks on the property owner; the specific heights should be confirmed with the town.
The town controls all trees, shrubs and plantings in any street, park, public right-of-way or easement (95.04), and the Tree Program Supervisor is the Street and Utilities Superintendent. Maintenance duty, though, sits with the abutting owner: 95.10 puts the clearance obligation on the adjoining property owner or occupant, and 95.17 lets the town order an owner to trim or remove a tree on the public parking strip abutting their lot, then do the work and assess the cost against the property if nothing happens within 15 days.
